THE FACTS.

* The critical "eyewitness", Harold Davis, was NOT at the scene of the crime.

* New medical and scientific evidence proves that Philip did NOT fire the fatal bullet.

* Five jurors say that YES, the new evidence WOULD have made a difference in the outcome of the sentencing. In Tennessee, it only takes ONE juror to prevent a death sentence.

* Lt. Oliver's daughter does NOT want to see Philip executed.

* There is NO constitutional requirement for Clemency requests to go through the Board of Pardons and Paroles and it is unreasonable to ask Philip to go before the Board when he has a lawsuit still pending against them from the 2001 Clemency Hearing.
